Welcome to Adbird, an affiliate marketing network connecting content creators with brands and products. By signing up and using Adbird, you agree to comply with the following Terms of Service. Please read them carefully.
1. Acceptance of Terms
By registering on Adbird, you acknowledge that you have read, understood, and agreed to these Terms of Service. If you do not agree, do not use our platform.
These Terms of Service constitute a legally binding agreement between you and Adbird, governing your use of our services, website, and platform. We reserve the right to update or modify these Terms at any time, and continued use of the platform after such modifications signifies your acceptance of the updated Terms.
2. Eligibility
You must be at least 18 years old and comply with all applicable laws in Turkey. By using Adbird, you represent and warrant that:
- You have the legal authority to enter into this agreement.
- You are not prohibited from using our platform under any laws or regulations.
- You will provide accurate and up-to-date information during the registration process.
If we discover that you have provided false information or violated any eligibility requirements, we reserve the right to suspend or terminate your account immediately.
3. Account Registration and Management
To access Adbird, you must create an account and provide accurate and complete information during the registration process. You are responsible for:
- Maintaining the confidentiality of your login credentials
- Any activity that occurs under your account
- Updating your information to ensure its accuracy
Adbird reserves the right to verify your identity and request additional documentation if needed. If we detect suspicious activity or multiple accounts from the same user, we may suspend or terminate the accounts without prior notice.
4. Prohibited Activities
Content creators are strictly prohibited from engaging in any fraudulent or deceptive activities, including but not limited to:
- Click fraud: Using bots, automated systems, or artificial methods to generate clicks or impressions.
- Fake traffic generation: Purchasing traffic, incentivizing clicks, or engaging in misleading promotional tactics.
- Misrepresentation: False advertising, misleading statements, or fake endorsements.
- Spamming: Sending unsolicited messages, bulk emails, or unauthorized promotions.
- Trademark and copyright violations: Unauthorized use of brand names, logos, or copyrighted content.
- Cookie stuffing: Manipulating tracking mechanisms to generate false conversions.
Any violation of these rules will result in immediate account termination, forfeiture of payments, and legal action if necessary.
5. Traffic Quality and Conversion Requirements
Adbird evaluates the quality and validity of the traffic and conversions generated by content creators. This clause governs how such traffic is assessed for compensation purposes.
5.1 Reseller-Originated Purchases
First purchases originating from resellers will not be counted as valid conversions for compensation purposes. If reseller-originated customers represent a low share of your overall referred traffic, Adbird may, at its discretion, disregard this. However, where reseller-originated first purchases represent more than 30% of your total referred first purchases, these conversions will not be accepted or compensated, and the corresponding earnings will be excluded from your payout. Adbird reserves the right to adjust this threshold where necessary to reflect traffic patterns specific to a given vertical or campaign.
5.2 Minimum Conversion Rate (1% Rule)
Adbird applies a minimum first-purchase-to-signup conversion rate of 1%. If the ratio of your first purchases to signups falls below 1%, only the portion of signups corresponding to a 1% conversion rate will be counted as valid for compensation purposes at the time of the payout request; the remaining signups will not be compensated in that request.
- Example 1: 100 signups β 1 first purchase = 1% ratio. This meets the threshold; no deduction is applied.
- Example 2: 250 signups β 1 first purchase = 0.4% ratio. This falls below the threshold; your payout will be calculated as if you had generated only 100 signups (the number corresponding to a 1% rate). The remaining 150 signups are not paid out at this time.
Signup Pool: Signups that are not counted toward a payout due to falling below the 1% threshold are not permanently forfeited. They are carried forward into a rolling pool for that calendar month. If you generate additional first purchases before the end of the same month, these pooled signups can be recalculated against your updated first-purchase count and may become eligible for compensation if the overall monthly ratio then meets or exceeds 1%. Any signups remaining in the pool that are not matched to a qualifying first purchase by the end of the calendar month expire and will not be carried over to the following month.
Where a product category or campaign has a materially different natural conversion profile, Adbird may apply a different threshold for that category or campaign, and will make reasonable efforts to communicate any such adjustment in advance.
5.3 Calculation, Notification, and Objections
The ratios and thresholds described in this clause are calculated automatically by the system at the time you submit a payout request, and you will be notified within the platform if a threshold has not been met and a deduction has been applied. If you believe a deduction under this clause has been applied incorrectly, you may raise a dispute in accordance with Section 6 (Payment and Compensation) within 30 days of the relevant payout.
5.4 Application
This clause applies to traffic and conversions generated from the effective date of this update onward and does not retroactively affect payouts already completed prior to that date.
6. Payment and Compensation
Content creators will be compensated based on actual sales and valid traffic generated. Payments are subject to the following conditions:
- Minimum payout threshold: You must reach the minimum payment amount to request a payout.
- Payment schedule: Payments are made on a weekly basis via payment method that the content creator selects.
- Payment disputes: If you believe a payment has been wrongly withheld, you must notify us within 30 days.
- Fraudulent activity: If fraud is detected, your earnings will be forfeited, and your account will be permanently banned.
7. Compliance with Turkish Laws
All users must comply with Turkish laws regarding advertising, data privacy, and online marketing practices. Adbird reserves the right to report unlawful activities to the relevant authorities.
- The Turkish Consumer Protection Law regarding misleading advertisements.
- The Personal Data Protection Law (KVKK) governing the handling of user data.
- E-commerce and affiliate marketing regulations set forth by Turkish authorities.
Failure to comply with these laws may result in account termination and potential legal action.
8. Termination and Suspension
Adbird reserves the right to suspend or terminate any account without prior notice under the following circumstances:
- Violation of these Terms of Service.
- Engagement in fraudulent or unethical practices.
- Violation of Turkish laws or industry regulations.
- Non-compliance with platform policies.
Upon termination, any unpaid earnings may be forfeited, and you will be prohibited from re-registering on the platform.
9. Limitation of Liability
Adbird provides its platform on an "as is" basis without guarantees. We are not responsible for:
- Any losses resulting from the use of our platform.
- Interruptions, downtime, or technical issues.
- Any reliance on information provided by third parties.
You use the platform at your own risk, and we disclaim all warranties to the fullest extent permitted by law.
10. Amendments
We may update these Terms of Service at any time. Users will be notified of significant changes, and continued use of the platform constitutes acceptance of the revised terms.
